Focusing on the study of the various ways of its passing-down, the extant forms, the third chapter presents the reasons of the necessity of its preservation and suggests some preservation measures.
If the applicant fails to bring an action within 15 days after the people's court has adopted the preservation measures, the people's court shall cancel the property preservation.
Where a people's court decides not to adopt property preservation measures or early enforcement, it shall render a written decision and specify therein the relevant factual and legal grounds.
Otherwise, the rights in the registered trademark shall be deemed to have been automatically released from the property preservation measures.
In adopting property preservation measures, the people's court may enjoin the applicant to provide security; if the applicant fails to do so, his application shall be rejected.
