Judicially, we should utilize judge's discretion for application of inverting the burden of persuasion and choice of medical identifications.
The APA adopts the customary common law rule that the moving party-that is, the proponent of a rule or order--has the burden of proof, including both the burden of going forward and the burden of persuasion. 5 U.S.C.A. § 556(d).
